Family Petitions for Parents (Green Card)
If the petitioner is a U.S. citizen and at least 21 years old, they are eligible to petition to bring their parents to live and work permanently in the United States.
If the petitioner is a lawful permanent resident, they are not eligible to petition to bring their parents to live and work permanently in the United States.
There is a 2-step process for the parent to become a legal immigrant:
- USCIS must approve an immigrant visa petition that you file for your parent.
- If the parent is outside the United States, the parent will be notified to go to the local U.S. consulate to complete the processing for an immigrant visa. If the parent is legally inside the U.S., he or she may apply to adjust his or her status to that of a lawful permanent resident.
